3. What do you require to obtain the divorce?

The only requirement is that the parties live separately and apart for 12 months from the date of the irretrievable breakdown of the marriage.

The Court is not interested in who was at fault to cause the breakdown of the marriage. Conduct is not relevant to granting a divorce.

In order for the Court to determine whether to grant a Certificate of divorce where there are children under the age of 18 years, the Court has to be satisfied regarding the welfare of the children, then the Court needs to know of the non custodial party/parent is still spending time with the children and as well if the children are receiving adequate child support are being properly maintained financially.
